Cakes Terms and Conditions

All cake sales made by Lydia Kraitman Cakes — including wedding cakes, celebration cakes and birthday cakes — are subject to the following terms and conditions. Nothing in these terms and conditions affects your statutory rights as a consumer. If there is anything you don't understand please feel free to contact us on hello@lydiakraitmancakes.com.

1. Consultations

1.1 Consultations are offered for wedding cakes, by appointment only, and can be booked through the website here. Appointments last approximately one hour, carried out over Zoom call.

1.2 Consultations are free of charge. If you'd like to try flavours beforehand, tasting boxes can be ordered separately.

1.3 During the consultation, the design of your cake will be sketched. This sketch remains our property until the booking fee has been paid, after which a copy will be sent to you.

1.4 Celebration and birthday cakes do not include a consultation. The design process is handled via the contact form or email. A celebration cake can be discussed during a wedding or dessert table consultation if part of a larger order.

1.5 Please advise us of any allergies or dietary requirements when booking.

2. Minimum Order

2.1 Wedding cakes: minimum order £500, not including delivery or cake stand hire. This is a minimum, not an average — most wedding cakes are priced between £700–£950 depending on design and detail.

2.2 Celebration and birthday cakes: minimum order £200.

2.3 Minimum order values are subject to change for dates further ahead.

3. Booking Fees

3.1 All cake orders require a non-refundable booking fee of £100. For orders with less than 4 weeks' notice, full payment is required at the time of booking.

3.2 All booking fees must be paid within 7 days of the booking form being sent; dates cannot be held open without the booking fee. After 7 days, if no fee has been received, the date will be released and another booking may be taken.

3.3 Orders are only confirmed once the booking fee has been paid. Booking fees are non-refundable and only transferrable in certain circumstances — see Section 17.

4. Payment Schedule

4.1 Once the design has been finalised, the final payment is due 28 days before your event, stated on the booking form, with a reminder sent a week before.

4.2 If final payment is not received 28 days before the event, we reserve the right to cancel the booking. The booking fee is then non-refundable and non-transferable.

4.3 We do not offer instalments or card payment. All payments are by BACS transfer.

4.4 Once full payment has been received, it is non-refundable.

5. Cake Details

5.1 Once the booking form has been sent, please review all details carefully — tier sizes (where applicable), flavour choices, spellings of names, allergen information, delivery time and contact numbers. Please advise us of any changes as soon as possible.

5.2 The cake will be made according to the booking form, so it's essential all details are checked carefully. Errors not picked up beforehand will not be considered our error.

5.3 Personalised decorative elements (toppers, printed icing, charms) will be ordered exactly as per the booking form, so please check spellings and numbers carefully.

6. Decorative Items Supplied By Third Parties

6.1 We cannot be held responsible for delays on items supplied by other companies, e.g. cake toppers, special order stands.

6.2 If a topper or stand is required, please give at least one month's notice, ideally longer.

6.3 If ordering a topper or stand yourself, please check size and weight capacity with us in advance.

6.4 We cannot be held responsible for errors in size, shape or design where ordering hasn't been carried out by us.

6.5 We reserve the right not to use anything supplied by a third party if we feel it's unsuitable.

7. Flowers Supplied By Florists (where applicable)

7.1 When fresh flowers are being added to a cake, please discuss requirements with your florist — we're happy to liaise on our requirements too.

7.2 The cost of fresh flowers is added to your florist's bill. Ordering a few extra is advised.

7.3 We can only work with what your florist provides on the day. Any unsuitable or toxic flowers won't be used — a toxic flower list is on the Journal section of our website.

7.4 If your florist doesn't meet us at the agreed time, we cannot always guarantee we can wait.

7.5 If we cannot wait, the florist would need to add the flowers themselves, and we cannot be held responsible for the result, or for flowers added in a way that may not be food safe.

8. Alterations To Orders

8.1 We're happy to make alterations up to 4 weeks prior to the event. Changes within 4 weeks cannot always be guaranteed.

8.2 Changes may be subject to an additional cost, discussed at the time.

8.3 Please check the amended order form carefully and let us know of any further changes.

9. Collection Of Cakes

9.1 Orders may be collected at a pre-arranged time, depending on design and size. Wedding cakes over 3 tiers, or with intricate decoration or sugar flowers, are not suitable for customer collection.

9.2 Cakes collected by the customer are boxed for transportation, with full care instructions provided. A signature is required confirming receipt in perfect condition. We take no responsibility for damage occurring after the cake has left us.

9.3 Cakes should be placed on a level, steady surface for transport, e.g. the passenger footwell of a car, and stored at room temperature and out of direct sunlight until taken to the venue.

9.4 The pre-arranged collection time must be adhered to. Failure to collect at the agreed time may mean the cake is only available later, at a time suitable for us.

10. Delivery & Set Up

10.1 Delivery is available and, where a cake requires stacking, includes set-up at the venue at a pre-arranged time.

10.2 If the delivery time needs to change, please advise us as soon as possible and at least 14 days in advance.

10.3 Delivery is charged at 50p per mile for the return journey from Ashcott, Somerset, calculated using Google Maps mileage. There is no separate set-up fee.

10.4 We prefer to add fresh flowers ourselves rather than having your florist attach them, to ensure they're food-safe and match the original design.

10.5 It's your responsibility to provide correct delivery information and timing, checked carefully on your booking form.

10.6 On rare occasions, a force majeure event — e.g. severe weather, public unrest, or other unexpected events — may make delivery impossible. We'll always do our best to deliver as prearranged, but some circumstances are out of our reasonable control. Adequate wedding or event insurance is advised.

10.7 It's your responsibility to provide set-up details and location at the venue. Please ensure the display location is level, stable, strong enough to hold the cake, and away from heat sources, sunny windows, or areas easily knocked by guests.

10.8 We reserve the right to change the cake's location if we feel it's unsuitable and may cause damage.

10.9 We reserve the right not to use a stand provided by the venue or yourself if we feel it won't hold the cake's weight. Suitable stands are available to hire.

10.10 We will photograph the cake at the venue as proof of delivery and set-up in perfect condition.

11. Non-Edible Elements

11.1 Some cakes contain non-edible elements such as dowels, collars, flowers, or toppers. Written information will be provided to you and/or the venue on anything needing removal.

11.2 As we will not personally be cutting the cake, we cannot accept responsibility for non-edible elements not removed prior to serving.

12. Shelf Life

12.1 Cakes are best eaten within 3 days of the event.

12.2 Leftover cake can be frozen — this can be discussed with you.

13. Allergens & Special Dietary Requirements

13.1 All allergy and dietary requirements should be conveyed when booking.

13.2 Unless otherwise stated, all cakes contain gluten, butter and eggs, and are made in an environment that handles nuts, soya, alcohol and other major allergens. Gluten-free, nut-free and dairy-free cakes can sometimes be made on request; trace amounts cannot be guaranteed absent.

13.3 Anyone with a severe nut, dairy or gluten intolerance is advised not to eat our cakes.

13.4 Full allergen information will be provided with the cake upon collection or delivery.

13.5 Lydia Kraitman Cakes accepts no liability for customers suffering allergic reactions.

14. Publication & Promotional Rights

14.1 Lydia Kraitman Cakes is the sole designer and owner of the final cake design.

14.2 Designs are sometimes published in the media. We reserve the right to use images of a customer's cake for publication after the delivery date unless previously agreed in writing.

14.3 The customer has no ownership rights over any cake design. Exclusivity is not guaranteed unless commissioned.

15. Commissioning A Cake Similar To Another Design

15.1 We will seek permission from the original designer to recreate a requested design. This cannot be guaranteed.

15.2 We cannot directly copy another design, but can use it as a basis for something unique to you.

16. Cancellations/Refunds

16.1 The booking fee is non-refundable and non-transferable.

16.2 Cancellations from booking until 28 days before the event forfeit the booking fee.

16.3 Cancellations with less than 28 days' notice are subject to full, non-refundable payment.

16.4 On rare occasions we may need to cancel due to exceptional circumstances beyond our control;* full notice and refund of monies paid, including deposits, will be given, along with assistance finding a replacement baker.

*Excludes force majeure on the event day — see Section 10.6.

17. Change Of Date

17.1 Wedding cakes: if the date can be changed within 12 months of the request, the booking fee will be transferred to the new date. If moving further than 12 months ahead, a new £100 booking fee is payable, with the original booking fee non-refundable.

17.2 Celebration and birthday cakes: if the date can be changed within 3 months of the request, the booking fee will be transferred. If moving further than 3 months ahead, a new £100 booking fee is payable, with the original deducted from the final cost.

17.3 If moving to a date we're unavailable for, the booking fee is non-refundable, as it covers work already completed.

17.4 Date changes to different years, or from off-peak to peak days/months, may be subject to an additional charge.

17.5 Taking out wedding or event insurance covering cancellation or date change beyond your control is strongly advised.

18. Complaints

18.1 Any issue with your cake must be brought to our attention within 48 hours of delivery so we can assess the problem.

18.2 For complaints regarding quality, we may ask for the cake or remainder to be returned within 48 hours for inspection.

18.3 For complaints regarding design, where the cake was made according to the checked and approved booking form, we cannot be held responsible for errors not picked up by the customer.

18.4 We can only deal with the person who originally booked the cake.

18.5 You agree to give us the opportunity to resolve any issue, and not to post defamatory comments or images before discussing the situation with us and allowing reasonable time for a resolution.

18.6 Once resolved, you agree not to post defamatory comments or images at any future point.

19. Exceptional Circumstances

19.1 If your booking needs to be postponed due to circumstances genuinely beyond your control — such as government-imposed restrictions, venue closure, or a public health emergency — we will do our best to be accommodating and flexible.

19.2 If we're able to move your booking to a new date within the applicable window (12 months for wedding cakes, 3 months for celebration cakes), the booking fee will be transferred.

19.3 If we're not able to accommodate a change because such circumstances prevent your event going ahead at all, the original booking fee will be refunded.

19.4 Postponements for reasons other than genuine circumstances beyond your control will be treated as a standard change of date or cancellation.

We reserve the right to revise and amend these terms and conditions. You will only be subject to the terms and conditions in force at the time you place your order with us.

By paying your booking fee, you are agreeing to these terms and conditions, so please read them carefully.
